Throughout these Terms of Service, the terms “we”, “us”, “our”, and “Nauport Models” refer to the store operator.

By visiting our website, browsing our products, creating an account, or placing an order, you agree to these Terms of Service, our Privacy Policy, Shipping Policy, and Return and Refund Policy.

These Terms apply to all visitors, customers, and users of the website.

3. Products and collector age recommendation

Nauport Models sells collectible scale models of aircraft, vehicles, trucks, trailers, figures, and related collector items.

Unless otherwise stated in the product description, our models are intended for collectors aged 14 years and older.

The products are not intended for unsupervised play by young children. Some models may contain small, detachable, pointed, or delicate components.

Customers are responsible for reviewing the product description, scale, dimensions, materials, assembly status, and age recommendation before placing an order.

4. Handmade and limited-edition products

Some Nauport Models products are handmade, hand-painted, assembled, or produced in limited quantities.

Because of the production process, minor variations in colour, markings, surface finish, positioning of small components, or packaging may occur. Such minor variations are not considered defects when they do not materially affect the overall appearance or intended collector use of the product.

Product photographs are intended to represent the item as accurately as possible. Colours may appear slightly different depending on lighting, photography, and the customer’s display settings.

5. Product information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, scales, prices, materials, availability, and other information are accurate.

However, typographical errors or unintentional inaccuracies may occur. We reserve the right to correct errors and update information before or after an order is placed.

Where an error materially affects an order, we will contact the customer and offer an appropriate solution, including cancellation and refund where applicable.

6. Orders

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order confirmation confirms that we have received the order. It does not always mean that the order has been finally accepted.

We may refuse or cancel an order where:

• the product is unavailable;
• the price or product information contains a material error;
• payment cannot be verified;
• the shipping destination is unavailable or restricted;
• the order appears fraudulent;
• fulfilling the order would violate applicable law or carrier restrictions.

When we cancel a paid order, the amount received for the cancelled products will be refunded through the original payment method, subject to the payment provider’s processing times.

7. Prices and payment

Prices are displayed in the currency selected or shown in the store.

The final amount charged may be affected by currency conversion performed by the customer’s bank, card issuer, or payment provider.

Available payment methods are displayed during checkout. The customer confirms that they are authorised to use the selected payment method.

We reserve the right to change prices at any time. Price changes do not affect orders that we have already accepted, except where a clear pricing error has occurred.

8. Taxes, customs duties, and import charges

Unless checkout expressly states otherwise, product prices and shipping charges do not include customs duties, import VAT, customs-clearance fees, brokerage charges, or other destination-country charges.

International customers are responsible for any charges imposed by the customs, postal, or tax authorities of the destination country.

We are not responsible for delays caused by customs inspections, requests for information, unpaid import charges, or local import restrictions.

Customers should check the import rules applicable in their country before ordering.

9. Shipping and delivery

Orders are shipped from Ukraine using the shipping method selected during checkout.

Shipping prices and estimated delivery times are displayed during checkout and are further described in our Shipping Policy.

Delivery times are estimates and are not guaranteed. Delays may occur because of customs procedures, postal disruptions, security restrictions, weather, public holidays, transport interruptions, or other circumstances outside our reasonable control.

The customer is responsible for providing a complete and accurate delivery address, postal code, recipient name, email address, and telephone number.

Additional costs caused by an incorrect or incomplete address, refusal of delivery, failure to collect a parcel, or unsuccessful delivery attempt may be charged to the customer where permitted by law.

10. Tracking

Where tracked delivery is provided, tracking information will be sent after the order has been dispatched.

Tracking information may not update immediately after dispatch and may temporarily stop updating while the parcel is transferred between postal operators or processed by customs.

11. Cancellations, returns, and refunds

Order cancellations, returns, exchanges, damaged products, and refunds are governed by our Return and Refund Policy.

Nothing in these Terms limits any mandatory consumer rights that apply under the laws of the customer’s country.

Where applicable, consumers purchasing online may have a statutory right to withdraw from a purchase. Products made to the customer’s specifications or clearly personalised may be excluded from that right where permitted by applicable law.

EU guidance generally gives consumers a 14-day withdrawal period for distance purchases, while clearly personalised or made-to-order goods can fall under an exception. Ukrainian law also treats online purchases as distance contracts and recognises exceptions for goods made or processed to a customer’s order.

12. Damaged or incorrect products

Customers should inspect their order promptly after delivery.

When a product arrives damaged, incomplete, or different from the product ordered, the customer should contact us as soon as reasonably possible at info@nauport.com.ua and provide:

• the order number;
• a description of the issue;
• photographs of the product;
• photographs of the internal and external packaging;
• photographs of the shipping label where relevant.

We will review the information and offer an appropriate solution in accordance with our Return and Refund Policy and applicable consumer law.

Customers should retain the product and all packaging until the claim has been reviewed.

13. Personalised and made-to-order products

Personalised, individually commissioned, modified, custom-painted, custom-marked, or made-to-order products may require advance payment and additional production time.

Once production has started, such orders might not be cancellable or returnable for change of mind where applicable law permits an exception.

This does not limit the customer’s rights where the product is defective, damaged, or does not conform to the agreed specification.

14. Intellectual property

All content on this website, including photographs, product descriptions, graphics, logos, designs, text, videos, and original model presentations, is owned by or licensed to Nauport Models unless otherwise stated.

Content may not be copied, reproduced, republished, modified, distributed, sold, or used commercially without prior written permission.

Product names, aircraft names, airline names, vehicle names, trademarks, and liveries belonging to third parties remain the property of their respective owners. Their use for descriptive or identification purposes does not imply sponsorship or endorsement unless expressly stated.

15. Prohibited use

You must not use the website:

• for unlawful or fraudulent activity;
• to provide false customer or payment information;
• to interfere with the operation or security of the store;
• to introduce malicious software;
• to copy or exploit store content without permission;
• to violate intellectual-property rights;
• to place orders using an unauthorised payment method.

We may restrict access, cancel orders, or report activity where we reasonably suspect misuse or fraud.

16. Third-party services

Our store may use third-party services for payments, delivery, analytics, communication, reviews, and other functions.

These services may be governed by their own terms and privacy policies. We are not responsible for independent third-party websites or services that are outside our control.

17. Availability of the website

We aim to keep the website available and accurate, but we do not guarantee uninterrupted or error-free access.

We may temporarily suspend, modify, or discontinue parts of the website for maintenance, security, technical, operational, or legal reasons.

18. Limitation of liability

To the maximum extent permitted by law, Nauport Models is not liable for indirect or consequential losses arising from:

• postal or customs delays outside our control;
• currency-conversion charges;
• third-party service interruptions;
• misuse of a collector model;
• failure to follow product safety information;
• inaccurate delivery information provided by the customer.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights or liability for defective products where applicable.

19. Governing law

These Terms and contracts concluded through the store are governed by the laws of Ukraine.

However, this choice of law does not deprive consumers of mandatory protections that apply in their country of residence.

Disputes should first be submitted to us at info@nauport.com.ua so that we can attempt to resolve the issue directly.

20. Changes to these Terms

We may update these Terms to reflect changes in our services, business practices, payment or delivery methods, or applicable legal requirements.

The current version will be published on this page together with the date of the latest update.

Changes apply from the date of publication and do not retroactively alter orders already accepted, except where required by law.
